Cablevision Appeals Loss of Remote-Storage DVR Ruling

Bethpage, N.Y. - Cable TV provider Cablevision announced on Tuesday that it will appeal a federal court ruling that said its proposal to build a network-based digital video recorder (DVR) system would infringe copyrights.

Movie studios and TV networks successfully argued that Cablevision's "remote-storage DVR," which would "store" programs a consumer elects to record on Cablevision's network -- rather than on the hard drive of a home-based device like a TiVo -- amounts to a "re-transmission" that requires additional permissions and payments.

"We continue to believe strongly that remote-storage DVR is permissible under current copyright law and offers significant benefits to consumers, including lower costs and faster deployment of this popular technology to our digital cable customers," said Cablevision COO Tom Rutledge.

"It does not alter the relationship between our customers and the programming they choose to record, and simply stores programming recorded by consumers in a central location."

Cablevision's appeal will be heard by the U.S. Court of Appeals for the Second Circuit.
