Boston - A judge told the company suing online social network Facebook for copyright infringement, breach of confidence, fraud and misappropriation of trade secrets that its case was lacking in concrete evidence, and gave the company until Aug. 8 to revise its complaint, CNET News.com reported. Facebook founder and CEO Mark Zuckerberg, along with several other early employees, are alleged to have stolen ConnectU's business model and source code while they were all students at Harvard. While Facebook now claims over 30 million users, ConnectU counts less than 100,000. Massachusetts Federal Judge Douglas P. Woodlock said ConnectU's copyright infringement claim is difficult to prove, as neither site was incorporated at the time, and no contracts exist. Judge Woodlock said ConnectU would do well to more effectively present its e-mail and voice message evidence when it files its revised complaint, at which point Facebook will then be given two weeks to respond.
