Perfect 10 Sues Microsoft for Copyright Infringement of Thumbnail Images

Beverly Hills, Calif. - Perfect 10, an adult entertainment firm, announced on Thursday that it has sued Microsoft for copyright infringement, alleging the company's MSN search engine makes unauthorized use of its images.

The company has also sued Google and Amazon.com's A9 search engine on similar claims; the Ninth Circuit Court of Appeals recently ruled that Google's use of thumbnail versions of Perfect 10 images on its search engine constituted "fair use," and upheld that framing full-size versions of the images hosted on unauthorized sites was not infringement.

"Microsoft is showing tens of thousands of extremely valuable celebrity images, along with Perfect 10 images, without authorization, which it obtains from hundreds if not thousands of pirate websites," said Perfect 10 president Norm Zada.

"Ironically, Microsoft has chastised Google for copying other people's work without permission, but now Microsoft is doing just that.”
