Digital Content Marketplace "Lulu" Sues NBCU/News Corp.'s "Hulu"

Raleigh, N.C. - Lulu Enterprises, which operates Lulu -- an online marketplace where creators can publish, buy and sell digital content -- has filed a trademark suit against "Hulu," the forthcoming Web video distribution joint venture between News Corp. and NBC Universal.

Lulu claims 1.2 million registered users and 3 million monthly unique visitors to its service, where users publish more than 4,000 new books, videos, calendars, songs and other pieces of new content each week.

Hulu, a site and service that will distribute TV shows, movies and other video from its backers and big-name media partners, is slated to launch in October.

In addition to trademark infringement, North Carolina-based Lulu.com's suit alleges unfair and deceptive trade practices and federal cyberpiracy.

"We have spent more than five years and tens of millions of dollars in investment successfully building the Lulu brand and website into a place for millions of creators and consumers to publish, buy, sell and manage digital content," said Lulu CEO Bob Young.

"It is clear we are required to move quickly to protect our intellectual property and defend ourselves against this infringement before it significantly damages our business."
