Appeals Court Sides With Fantasy Games Over Baseball Players

St. Louis - The U.S. Court of Appeals for the 8th Circuit has refused to rehear an appeal of a ruling that said fantasy baseball game providers can use actual names and statistics on players in their games, the St. Louis Business Journal reports.

The denial lets stand a ruling that sided with CDM Fantasy Sports, which argued that its First Amendment rights to the information trumped rights of publicity of the Major League Baseball Players Association and Major League Baseball Advanced Media (MLBAM).

MLBAM and the players' union have not yet said whether they will appeal the case to the U.S. Supreme Court.
