Patent Office Upholds TiVo Patent; EchoStar Appeal Still Pending

Alviso, Calif. - TiVo (NASD: TIVO) announced on Thursday that the U.S. Patent Office has upheld its "Time Warp" patent on digital video recording technology, after a reexamination was requested by rival EchoStar (NASD: DISH), whom TiVo is suing for infringing the patent on its own recorders.

The Patent Office's decision may not be appealed by EchoStar, although it does not impact EchoStar's separate appeal of a federal court's finding that it is infringing TiVo's patent.

"We are hopeful that the Federal Circuit will reverse the district court and find that we do not infringe Tivo's patent," EchoStar, operator of the DISH Network satellite TV service, said in a statement.
