RIAA to Pay Attorneys Fees in Dismissed File-Sharing Case

Portland, Ore. - A woman sued by the Recording Industry Association of America (RIAA) for illegal file-sharing, whose case was dismissed with prejudice for lack of evidence, will receive attorneys fees from the record label trade group after a federal judge affirmed her motion yesterday, the Recording Industry vs. the People blog reports.

Tanya Andersen was sued by the RIAA for copyright infringement (Atlantic v. Andersen) in 2005; after the case was dismissed, a magistrate judge granted Andersen's motion for attorneys fees.

U.S. District Court Judge James A. Redden affirmed that ruling yesterday. The court has yet to decide on an amount to award Andersen.

Meanwhile, Andersen's countersuit against the RIAA, which claims electronic trespass, violations of computer fraud and abuse statutes, RICO violations, invasion of privacy and other charges, is still pending in the courts.
