EMI Settles Ringtone Litigation With InfoSpace

New York - Major label EMI has settled the ringtone royalty lawsuit it filed in January against mobile content distributor InfoSpace, MocoNews reported, citing an InfoSpace regulatory filing.

EMI had sought in excess of $10 million in damages for alleged breaches of contract, as well as statutory damages for alleged copyright infringement that ran to "many millions" of dollars.

The label said the InfoSpace was selling ringtones for which it did not hold licenses, such as for John Lennon's song "Imagine," and also selling them in territories for which it was not authorized.

For its part, InfoSpace denied the charges and filed a $1.5 million countersuit against EMI, claiming breach of contract and tortious interference.

While terms of the settlement were not disclosed, InfoSpace said it does not expect the settlement will materially and adversely affect its business or results of operations.
