Apple Faces Class Action Suit Over iPhone 3G Reception Issues

Los Angeles - A day after acknowledging that a software update for its iPhone 3G was issued to help remedy widespread reports of problems connecting to 3G networks, Apple (NASD: AAPL) was hit with a class action lawsuit that claims the network is slower than was advertised. Filed in federal court by Birmingham, Alabama resident Jessica Alena Smith, the lawsuit -- which seeks class action status -- charges Apple with breach of express and implied warranty, and unjust enrichment.

The suit specifically mentions Apple's billing of the iPhone 3G as "twice as fast for half the price" of the original model, which runs on a 2.5G network.

The plaintiffs want a court to compel Apple to either repair or replace all defective iPhone 3Gs, and pay unspecified damages, interest and attorneys' fees.

Class Action

Amen - I love the gadget but hate the phone aspect. Horrible dropped calls and really crummy reception, in an area near Philadelphia that is supposed to be solid on coverage. They gotta fix this thing!!
