TiVo Gets $105M From DISH; Expects More to Come

Alviso, Calif. - TiVo (NASD: TIVO) announced that it has received a payment of $104.6 million from DISH Network operator EchoStar Communications (NASD: DISH), an award in a patent infringement case over digital video recorder technology. The Supreme Court earlier this week refused to hear a final appeal from EchoStar; meanwhile, TiVo believes it will be due even more damages, stemming from another pending claim over whether EchoStar failed to disable its digital video recorders per order of an injunction.

The payment made by EchoStar this week includes $74 million in damages for willful patent infringement, as well as supplemental damages and interest.

"We remain confident that the District Court will enforce the injunction and award further damages from EchoStar's continued infringement of our Time Warp patent," TiVo said in a statement.

Many analysts say that, once the four-year litigation is fully behind them, TiVo and EchoStar may end up as partners -- as they each hold technology that could complement the other's offering.
