RIAA Appeals Parts of Copyright Royalty Board Terms

Washington - The Recording Industry Association of America (RIAA) has filed an appeal of the Copyright Royalty Board's final determination of mechanical royalties for digital music with the U.S. Court of Appeals in the District of Columbia, Billboard reports.

In its appeal, the RIAA terms the CRB order as "contrary to law, clearly erroneous, arbitrary and capricious, and abuse of discretion, and not supported by substantial evidence."

Sources told Billboard that the RIAA specifically will take issue with the late fees that are to be imposed on labels making royalty payments to publishers, and the royalty rate set for master recording ringtones.

The RIAA and National Music Publishers Association had been negotiating a settlement on the late fees issue, according to Billboard, but so far to no avail.
