Apple Sued Over iTunes Gift Cards, Price Hike to $1.29 Songs

San Francisco - Apple (NASD: AAPL) has been sued for breach of contract and consumer fraud by two Illinois residents, who claim the company misled them by marketing its gift cards for the iTunes Store as redeemable for 99-cent songs, when in fact some songs now cost $1.29 each, CNET News.com reported.

Daniel and Barbara Owens claim in their lawsuit that they were "denied the benefit of their bargain to purchase any song" on iTunes for 99 cents.

The couple say they purchased iTunes Store gift cards from Sam's Club and Wal-Mart in March and May.

Apple changed its pricing structure in April to allow labels to price songs at 69 cents and $1.29, in addition to the industry standard 99-cent price point.

Apple did not comment on the story for CNET.
