Singapore – An appeals court in Singapore has overturned a
lower court, finding devices that record over-the-air broadcast television
transmissions for playback online do not infringe copyrights.

The lower court
found RecordTV guilty of copyright infringement of programs owned by MediaCorp,
and dismissed RecordTV’s claim against MediaCorp of making groundless threats
to bring legal proceedings for copyright infringement.

RecordTV functions
similarly to a "remote-storage" digital video recorder, where
recorded programs are stored on RecordTV servers rather than on a device in
consumers’ homes.

In the U.S., cable TV provider Cablevision was sued over the
remote-storage DVR concept, but the Justice Dept. sided with the company in a
court filing and last year the Supreme Court declined to hear an appeal from
broadcasters of a ruling declaring such services legal.
