There are two obstacles impeding the XM-Sirius merger: The Department of Justice (DoJ) and the FCC. The former must agree that the combined entity does not violate antitrust laws, and the latter must overlook the rule that one company cannot own both satellite licenses. The FCC has indicated that it could overturn the rule, but has not offered reasons that would compel it do so. The DoJ has offered no insights, either. But there should be little doubt: the merger will cross both hurdles unobstructed.

Washington, DC - XM Satellite Radio, the DC-based provider of subscription satellite radio services, said on Friday that it added more than 442,000 new net subscribers during the fourth quarter, but fell just short of its target for the year. XM finished the year with 7.625 million subscribers, missing its own estimates of 7.7-7.9 million. The company, however, said that it achieved positive cash flow from operations during the fourth quarter.

However, as late as December 4, Sirius lowered its subscriber guidance to between 5.9 and 6.1 million subscribers, down from a previous projection of more than 6.2 million subscribers. The reason given was slower-than-expected sales after Thanksgiving.

This weekend I headed to the movie theater to see A Night at the Museum, and before the film there was preview for the Metropolitan Opera's new initiative -- Saturday Matinees Live in HD at local theaters around the world. I have to admit, what first caught my attention in the trailer was the multiple "Apple-esque" logo placements for Edelman in the first moments of the spot. As it turns out, this effort is part of the Met's new marketing strategy in 2007 to broaden the appeal of the Opera to a wider global audience (and presumably realize another stream of revenue from productions as well). Along with the 8 live HD broadcasts of performances in movie theaters, they are also broadcasting weekly audio programs through a partnership with Sirius Radio. The website provides details on all the programs, including some nice links to allow patrons to support the Met in other ways by contributing or spreading the word.

Some 12% of Internet users surveyed by Pew Internet & America Life Project now say that they have downloaded a podcast so that they can listen to it or view it at a later time. This is a big increase from the February-April study when the number was just 7%. The significant gain is attributable to the increase in the number of owners of MP3 players (iPods and the like) and the growing number of organizations that offer podcasts. However, only a few people listen to podcasts frequently, only 1% of the people in the survey say that they download and listen to podcasts every day.
