eMusic Parent Makes Bid for The Orchard

New York - Dimensional Associates, the private equity unit of JDS Capital that owns digital music service eMusic, is in talks to acquire all of the shares of digital music and video distributor The Orchard (NASD: ORCD) it does not already own, PaidContent reported, citing an SEC filing.

New York - Greg Scholl, the president and CEO of independent digital music distributor The Orchard until he resigned a week ago, has been named president of local media platforms for NBC Universal, PaidContent reported.

Orchard CEO Resigns; Company Lays Off 20% of Staff

New York - The Orchard (NASD: ORCD), a digital distributor of independent music and video content, announced on Wednesday that president and CEO Greg Scholl has resigned, and additionally that the company has laid off 20% of its staff as part of a cost-cutting initiative. Scholl will remain on through the end of October, at which time Danny Stein -- an Orchard board member and currently also chairman and CEO of eMusic -- will replace him as interim CEO.

MySpace, The Orchard Respond to Indie Label Equity Questions

Los Angeles - After independent record label bodies including Merlin and A2IM criticized MySpace (NYSE: NWS) for not offering them an equity position in its MySpace Music joint venture with the major record labels, MySpace responded in a statement saying it offered all labels the same deal, while independent music digital distributor The Orchard, which signed on with MySpace Music, explained its decision. "We have offered a relationship with Merlin that provides equal opportunities to Merlin's labels and Merlin's artists that we have provided to ALL labels and artists whether they are Indie Artists, Major Artists or Unsigned artists," reads the MySpace statement.

The Orchard Completes Merger with Digital Music Group, Inc.

New York - The Orchard has completed its merger with Digital Music Group, Inc. (NASD: DMGI), a fellow provider of digital distribution services for music and video. Under terms of the all-stock transaction, shareholders of The Orchard will own about 60% of the combined company, which will be based out of New York, and continue to be led by Orchard president and CEO Greg Scholl.
