Washington - Shares of XM Satellite Radio fell 5.5% on Thursday after the company released first quarter results and revealed that the Federal Trade Commission (FTC) has launched an investigation into its marketing practices. The company said that it received a letter on Tuesday stating that the FTC is looking into whether its marketing activities comply with various acts, including the FTC Act, the Telemarketing Sales Rule, the Truth in Lending Act and the CAN-SPAM Act. The letter requested information about such practices as free trial periods, rebates and telemarketing. The company has launched its own internal review. Separately, the Federal Communications Commission (FCC) said that one of the company's satellite radios, the Delphi XM SKYFi2, is not in compliance with federal emission limits. The company said that it's conducting an internal probe into that matter, as well. XM said it ended the quarter with 6.5 million subscribers, up 72% from the 3.8 million it reported in the same period a year ago, and still expects to count 9 million subscribers by the end of the year.

Los Angeles - Major record labels Universal Music Group and EMI Group have been ordered to turn over "privileged documents" to a federal judge, who said there was reasonable cause to believe earlier redacted versions submitted to a Justice Dept. probe into digital music price fixing were "deliberately misleading," Reuters reported. The labels initially submitted the documents in 2001, during a Justice Dept. probe into alleged digital music price fixing amongst the labels and their joint ventures Pressplay and MusicNet. That probe ended in 2003, finding no evidence of wrongdoing. However, in a lawsuit the labels later filed against Napster investors, for supporting a copyright infringing business, venture capital firm Hummer Winblad alleged the labels knowingly submitted false or misleading documents. U.S. District Court Judge Marilyn Hall Patel on Friday ordered Universal Music Group and EMI Group to provide unedited versions of the documents in question within 30 days.

Brussels -- The European Commission has launched an investigation into Apple Computer for charging more for iTunes music downloads in the U.K. than in France or Germany, Reuters reported. "There is indeed an investigation on our own initiative," an unnamed Commission spokesman told Reuters. "We have made informal requests to Apple just to gather information." Reuters said the probe, which comes in response to a complaint filed with the U.K. Office of Fair Trading by consumer association Which?, was still in its early stages. Which? complained that consumers in the U.K. who must pay $1.51 per download are prohibited from using websites in France and Germany, where downloads cost just $1.31. Apple charges $0.99 for songs in the U.S., and $0.80 per song in Canada. "We look forward to the Commission taking action to ensure that the market for digital music is a single European market and serves all of Europe's consumers equally," Which?'s Phil Evans told Reuters.
