Live365 Asks Court to Examine Copyright Royalty Board

Washington - Online radio service Live365 announced on Tuesday that it has filed a federal lawsuit seeking to halt any further webcasting royalty rate-setting proceedings before the Copyright Royalty Board (CRB), until the issue of whether the judges on the board were appointed in violation of the Constitution's separation of powers is resolved. The company points to recent opinions by the U.S. Court of Appeals for the District of Columbia, including one that stated that the CRB "exercises expansive executive authority ... unsupervised by the Librarian of Congress or by any other Executive Branch official," adding that the "statutory structure raises a serious Constitutional issue."

Live365 Decries Webcasting Rate Deal; Submits Own Proposal

Foster City, Calif. - Live365, a provider of "microwebcasting" services that power Web radio stations from over 5,000 users, said on Thursday that the royalty rate deal announced this week by SoundExchange will have detrimental effects to its business, and submitted its own rate proposal to the agency.

Foster City, Calif. - Internet radio distributor Live365 announced on Tuesday that its service is now available on mobile phones running Microsoft's Windows Mobile 5 or 6. The Radio365-Mobile service offers user-programmed stations in 260 genres originating from over 150 countries. A commercial-free, VIP subscription is available for $5.95 per month after a 15-day free trial.

Large Webcasters Petition Lawmakers for Royalty Rate Parity

Washington - Large Internet radio purveyors AOL (NYSE: TWX), Yahoo (NASD: YHOO), RealNetworks (NASD: RNWK), Pandora and Live365 earlier this week sent a letter to key lawmakers in Washington, asking them to consider performance royalty parity for broadcast, satellite, cable and Internet radio. The letter was addressed to U.S. House Intellectual Property Subcommittee Chairman Howard Berman (D-Calif.) and Senate Judiciary Committee Chairman Patrick Leahy (D-Vt.), whose committees are currently re-evaluating the broadcast radio industry's royalty rate exemption.

Washington - The U.S. Copyright Office announced that it has received a notice of intent from SoundExchange, the recording industry entity set up to collect and distribute royalties for digital music, to audit the 2005 statements of Live365, an Internet radio broadcaster.

Los Angeles - American Idol Underground, an online version of the popular reality TV show developed by Fluid Audio Networks, announced on Tuesday that a Web radio station featuring performances from contestants has been launched on Internet radio network Live365.
