Los Angeles - A federal judge has granted summary judgment in favor of the movie studios and record labels who sued file-sharing firm StreamCast Networks, distributors of the Morpheus peer-to-peer application, for copyright infringement. The ruling, which StreamCast may still appeal, is part of the aftermath of the landmark 2005 Supreme Court ruling that found providers of file-sharing software liable for copyright infringement committed by users. The Supreme Court sent that suit back to U.S. District Judge Stephen V. Wilson, whose initial 2003 ruling in favor of StreamCast started the case on its way up the appeals process. Judge Wilson's ruling on Wednesday cited "overwhelming" evidence of StreamCast's "massive infringement." "No single court ruling solves piracy or can make up for several challenging years for the music community, but there's no doubt that that rules of the road for online music are better today than they were yesterday," said RIAA chairman and CEO Mitch Bainwol.

Los Angeles -- Two file-sharing services that won a landmark court ruling placing the burden of copyright infringement with individual users on Wednesday filed briefs in an appeal of that ruling brought by the music and movie industries. The original ruling said that Grokster and Streamcast Networks, which operates Morpheus, were not guilty of copyright infringement -- starkly contrasting the case against Napster, which was found guilty of copyright infringement. The Recording Industry Association of America (RIAA), Motion Picture Association of America (MPAA) and National Music Publishers Association (NMPA) filed their appeal with the Ninth Circuit Court of Appeals in San Francisco in August; Grokster and Streamcast Networks filed their response on Wednesday. "Instead of asking the court to deputize every technology vendor to enforce their copyrights for them, they should license the technology at a fair price," Grokster president Wayne Rosso told Reuters. Nashville, Tenn. -- The CEO of StreamCast Networks, operator of the Morpheus peer-to-peer file-sharing network currently being sued by entertainment companies for copyright infringement, announced his resignation from the company late Friday. The company said CEO Steve Griffin left "to pursue other opportunities." Tennessee-based StreamCast, which along with fellow file-sharing providers Grokster and Kazaa was sued by most of the major movie studios and record labels, said it is currently seeking a replacement for Griffin and that its management team will run the company's operations in the meantime.
