New Bills Would Limit Liability on Use of "Orphan Works"

Washington - A bipartisan group of powerful lawmakers this week introduced legislation that would mitigate the legal risk and potential damages associated with the use of "orphan works," or songs, books or other copyrighted media where the creator or owner cannot be identified. Senate Judiciary Committee Chairman Patrick Leahy (D-Vt.) and Sen. Orrin Hatch (R-Utah) are sponsoring the Shawn Bentley Orphan Works Act of 2008 in the Senate, while House Judiciary IP Subcommittee Chairman Howard Berman (D-Calif.) and House Judiciary Committee ranking member Rep. Lamar Smith (R-Texas) introduced The Orphan Works Act of 2008 in the House.

Digital Watermarking Alliance White Paper Addresses P2P, "Orphan Works"

Washington - The Digital Watermarking Alliance (DWA), a trade group of companies supporting the digital rights management technology, on Monday announced the publication of a white paper that discusses how digital watermarking can address the issue of "orphan works," or those whose copyright owners cannot be identified or located.

U.S. Appeals Court Rejects Challenge to Copyright Term Lengths

San Francisco - The U.S. Court of Appeals for the Ninth Circuit has rejected an appeal from Internet activists, including Internet Archive founder Brewster Kahle, that would have reexamined the extensions to copyright term lengths enacted during the 1990s.
